Terms of Service

These terms govern your use of Tallingo (“the Service”, “we”, “us”), available at tallingo.com. By creating an account or using the Service, you agree to these terms. If you don’t agree, don’t use the Service.
1. Eligibility
You must be at least 13 years old to create your own account. If you’re under 13, a parent, coach, or program director must create and operate the account on your behalf. By using the Service you represent that the information you provide is accurate and that you have the right to provide it.
2. Your account
You’re responsible for activity under your account, including keeping your sign-in credentials secure. Tell us right away if you believe your account has been compromised. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a security or legal risk.
3. Acceptable use
When using the Service, you agree not to:
- Harass, threaten, or impersonate other users.
- Submit display names, team names, or other content that is obscene, hateful, or otherwise inappropriate (we filter common cases automatically and review reports).
- Attempt to bypass rate limits, scrape large volumes of scenarios, or reverse-engineer paid features.
- Use the Service to violate any law or to infringe anyone’s rights.
- Resell, sublicense, or redistribute Tallingo content (scenarios, explanations, certificates, field guides) without our written permission.
4. Subscriptions and payments
Tallingo offers a Free tier and paid Coach and Program tiers. Paid subscriptions are billed in advance on a recurring basis through our payment processor (Stripe). By subscribing, you authorize us to charge the payment method you provide for the subscription fees and any applicable taxes until you cancel.
Prices are shown on the pricing section of the site. We may change prices for future billing periods on at least 14 days’ notice; the new price applies starting with your next renewal.
Cancellation. You can cancel a paid subscription at any time from your billing page. Cancellation takes effect at the end of your current billing period; you keep access to paid features until then.
Refunds.We don’t offer prorated refunds for partial billing periods. If you believe you were billed in error, email us at [email protected] within 30 days and we’ll review it.
5. Free tier
We offer a Free tier with access to all scenarios, personal progress, leaderboards, and basic team features. We may change what’s included in the Free tier at any time, but we’ll give reasonable notice on the site before reducing existing free functionality in a material way.
6. Content and intellectual property
Our content.Tallingo, the scenarios, explanations, mascots, field guides, certificates, and all design and code are owned by us (or our licensors) and are protected by copyright and other laws. We grant you a personal, non-transferable, non-exclusive license to use the Service for its intended purpose. We don’t grant you any other rights.
Your content. When you create content within the Service (a team, a program, a custom assignment, an error report, your display name, etc.), you keep ownership of it. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and process that content as needed to operate the Service for you and your team or program.
Feedback. If you send us feedback, suggestions, or ideas about the Service, we may use them without obligation to you.
7. Educational guidance, not officiating
Tallingo is an educational tool. Scoring decisions, rule interpretations, and game guidance are designed to be accurate but may not reflect every league’s specific rule set or every edge case. Don’t use Tallingo as a substitute for an actual rulebook, official scorer, or umpire when an authoritative call is required. We are not affiliated with MLB, NCAA, NFHS, USA Softball, USSSA, or any other governing body unless explicitly stated.
8. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that it will meet your specific requirements.
9. Limitation of liability
To the fullest extent permitted by law, Tallingo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $100.
10. Indemnification
You agree to defend and indemnify Tallingo from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or your violation of these terms.
11. Termination
You can stop using the Service at any time and request account deletion by emailing us. We may suspend or terminate your access if we reasonably believe you have violated these terms or applicable law. On termination, sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
12. Governing law
These terms are governed by the laws of the United States and the state in which Tallingo is operated, without regard to conflict-of-laws principles. Any dispute that isn’t resolved informally will be brought in the state or federal courts located in that state, and you consent to the personal jurisdiction of those courts.
13. Changes
We may update these terms from time to time. When we make material changes, we’ll update the “Last updated” date and, where appropriate, notify you in the product. Continued use of the Service after a change means you accept the updated terms.
